Overview

The new VOB/A consists of three clauses. Section 1 contains unchanged section 1 as published in 2010-08, except that in the German text the word "Verdingungsunterlagen" has been changed to "Vergabeunterlagen" and in Annex TS "Europäische Gemeinschaften" has been changed to "Europäische Union". The provisions of this clause apply to contracts beneath EU thresholds. Section 2 "Provisions relating to the award of contracts falling within the scope of Directive 2004/18/EC of the European Parliament and of the Council of 31 March 2004 on the coordination of procedures for the award of public works contracts, public supply contracts and public service contracts" has been completely revised. In section 2 the previous structure dividing the specifications into "basic articles" and "a-articles" has been replaced by a new structure in which the specifications are continuously numbered. As a rule the existing regulations in section 2 shall be retained. Numerous paragraphs have been restructured and linguistically adapted to the source texts. Some modifications regarding the content were still necessary. They concern in particular the current paragraphs 1 EG, 8 EG, 10 EG, 16 EG as well as 19 EG. Section 3 "Provisions relating to the award of contracts falling within the scope of Directive 2009/81/EC of the European Parliament and of the Council of 13 July 2009 on the coordination of procedures for the award of public works contracts, public supply contracts and public service contracts by contracting authorities or entities in the fields of defence and security" has been incorporated. It contains provisions for construction contracts in the defence and sensitive security sectors which are above EU thresholds. Sections 2 and 3 each now have an Annex I "Requirements relating to devices for the electronic receipt of tenders and requests for participation" and an Annex TS "Types of Technical Specification".
